1. INTRODUCTION

Shows in the U.S., Inc. (“Company,” “Us,” “Our,” or “We”) respects the privacy of the visitors and users of the Company’s website located at https://localshows.com and associated mobile application (“Site”). This privacy policy (“Policy”) is an agreement between Company and You, as the user of the Site (“You”) and governs Our collection of information from You. 

2. AGREEMENT TO TERMS OF PRIVACY POLICY AND TERMS OF USE

All of Your activities on the Site are voluntary. You are not required to provide any personal information unless You choose to access features on this Site which require such information to be provided. If You do not agree with the terms of this Policy or Our Site Terms, then You should immediately exit the Site and discontinue using the Site.  Our Site Terms are expressly incorporated herein by reference and made a part of this Policy. By using the Site, You signify that You agree to the terms of this Policy as well as to Our Site Terms. By using our Site, you consent to the collection and processing of your personal information as described in This Privacy Policy. For certain data collection activities, such as sensitive data or automated decision-making, we will obtain your explicit consent where required by law.

3. CHANGES TO PRIVACY POLICY

This privacy Policy is effective as of the inception of the Site and will remain in effect except with respect to any of its provisions that are changed thereafter by Company. All revisions to this Policy will become effective on the date they are posted on the Site or the date that We notify You of the revisions, whichever is earlier. We reserve the right to change this Policy at any time.  You should check this Policy periodically as its terms may change from time to time. Your continued use of the Site after modifications to this Policy are posted will constitute Your agreement to abide by and be bound by the modified Policy terms.

This Policy applies to Your activities on or through the Site and Services, including Company’s website, platform, mobile application, and related online interactions. This Policy shall be applied in a manner consistent with applicable laws and regulations in the jurisdictions where Our users are located.

 Identifiers include information such   as Your name, email address, phone number, IP address, device information,   and other identifiers that may be provided by You during checkout or account   creation, or collected automatically through cookies, pixels, analytics tools,   or similar technologies used on the Site.

• detect,        investigate and prevent fraudulent transactions and other illegal or        unauthorized activities and protect the rights and property of Company        and others;
• respond        to your comments, questions and requests and provide customer service.

Customer Data and Related Information
includes data submitted to, uploaded to, posted to,   transmitted through, or otherwise processed in connection with the Services,   including event information, venue information, show listings, promotional   materials, photographs, videos, reviews, messages, communications, account   information, and other materials provided by or on behalf of a user or   customer.

We use this information to

· provide, operate, maintain, and   improve the Services and related functionality; 

· process, store, and transmit   Customer Data in accordance with applicable agreements;

· enable posting, display,   management, promotion, moderation, and operation of event listings, user   content, communications, and related Site features; 

· support integrations with   third-party systems designated by You;

· provide customer support and   troubleshoot issues;

· ensure system security,   integrity, and fraud prevention;

· comply with legal, regulatory,   and contractual obligations

When you access or use our    services, we may automatically collect information about you, as follows:

 We collect log information about Your use of the Site, including the type of   browser You use, access times, pages viewed, Your IP address, the page You   visited before navigating to the Site, and information regarding Your   interactions with pages, links, products, and features.

 We may collect general location information derived from Your IP address when   You access the Site. We do not collect precise or GPS-level location data.

Cookie Information
 We use cookies, pixels, tags, and similar technologies to operate the Site   and to understand user activity, including through service providers,   analytics providers, customer support tools, payment processors, advertising   partners, and technology vendors, Google Analytics 4, Meta Pixel, Meta   Conversion API, and TikTok Pixel. Most browsers are set to accept cookies.   You may adjust Your cookie preferences through browser settings or any   consent tools provided on the Site. Company may implement additional cookie   consent tools in the future to comply with regional legal requirements. 

Inferences
 We may derive inferences from the information We collect, such as interests,   browsing tendencies, or general location, to help improve the Site,   personalize Your experience, or support marketing and analytics.

User Content
User-generated content includes product reviews,   feedback, photographs, videos, or other content You voluntarily submit   through the Site or through campaigns, collaborations, or promotional   programs. We do not collect job postings, work history, or similar   information.

6.  ADDITIONAL INFORMATION WE MAY COLLECT

A. TYPES OF INFORMATION COLLECTED. There may be other instances in which We collect information from You that is more general in nature (“General Information”). General Information may include Your Internet Protocol (IP) address, device identifiers, browser type, and other technical information used to identify Your computer or device on a TCP/IP network. This information may be collected whenever You access the Site, whether or not You provide Us with any Personal Information. General Information may also include device-level information collected through service providers, analytics providers, customer support tools, payment processors, advertising partners, and technology vendors, including GA4, Meta Pixel, Meta Conversion API, TikTok Pixel, analytics, customer support, operational measurement, and similar technologies  and other technologies used to operate the Site and related digital properties. 

B. CLICK STREAM DATA. When You visit the Site, We may collect click stream data, including but not limited to server address, domain name, pages viewed, products browsed, the time and length of visits, referral URLs, and related browsing activity (“Click Stream Data”). This information may be combined with other information You provide to Us and may be used for traffic analysis, analytics, personalization, ad performance measurement, and to determine which features of the Site are most or least effective.

C. WEB BEACONS. A web beacon is an object that is embedded in a webpage or email that is usually invisible to and allows website operators to check whether the user has viewed a particular page or email (“Web Beacon.”) We may use web beacons, pixels, tags, SDKs, APIs, and similar technologies on the Site, within communications, or through third-party advertising and analytics services or in Our emails to determine whether users have viewed specific pages or emails and to gather related information for analytics, security, advertising, and operational purposes. These technologies may be used in connection with service providers, analytics providers, customer support tools, payment processors, advertising partners, and technology vendors, GA4, Meta Pixel, Meta Conversion API, and TikTok Pixel. Personal Information is generally not collected directly through the use of Web Beacons. Users may adjust their browser or cookie settings to limit certain types of tracking.

D. MOBILE DEVICE DATA. If You access the Site or services using a mobile device, We may collect information relating to Your mobile device, including device ID, model, manufacturer, operating system and version, IP address, mobile network information, browser type, and other device-level data. This information may be used for functionality, analytics, security, fraud prevention, and performance optimization.

E. GEO-LOCATION INFORMATION. Information relating to Your location, and the location from which You are accessing Our services, may be collected, including general location data derived from Your IP address, region-level location, and other geolocation information provided by Your device or browser. We do not collect precise GPS-level location data unless You expressly authorize such collection. General location information may be used for analytics, security, fraud prevention, personalization, and compliance with regional legal requirements.

F. PUSH NOTIFICATIONS. We may send You push notifications if You choose to receive them, including notifications related to orders, promotions, or account activity. To opt out of these types of communications, You may turn them off in Your device or browser notification settings at any time.

G. NON-IDENTIFYING INFORMATION. We may collect other information that does not identify You directly, such as demographic information, zip codes, aggregated browsing data, information about Your use of the Site, and other non-personally identifiable data (“Non-Identifying Information”). We may combine information collected from users into hashed or coded formats (“Hashed Information”). While Hashed Information does not identify You directly, it may be used by Company or its partners to understand user interests, measure Site performance, and improve advertising and analytics.

H. THIRD PARTY ANALYTICS PROVIDERS AND SIMILAR VENDORS. Company works with (and may in the future work with) ad networks, ad agencies, analytics providers, and other vendors to provide Us with information regarding traffic on the Site, including pages viewed and actions taken; to measure ad effectiveness; and to serve advertisements to You on other websites, within mobile applications, or online services. Our service providers, including Google Analytics 4, Meta Pixel, Meta Conversion API,  or others, may collect certain information about Your visits to and activity on the Site and may set and access their own tracking technologies (including cookies, pixels, and web beacons). These parties may use that information to provide Us with analytics, personalize content, and show You advertisements that may be of interest to You. Some of these parties may collect Personal Information when You visit the Site or other online websites and services.

We may also share certain Non-Identifying Information, including Hashed Information, with these parties in connection with the services they provide. If You wish to opt out of interest-based advertising from participating companies, You may use the opt-out tools provided by Your browser settings, through Your account settings where applicable, through any cookie consent tools made available on the Site, or through industry opt-out tools such as those offered by the Network Advertising Initiative and the Digital Advertising Alliance. You must opt out on each device and each browser for Your preferences to apply. If You choose to opt out, You will continue to receive advertisements, but they may be less relevant to You.

While We may use a variety of service providers to perform advertising services, some of these companies are members of the Network Advertising Initiative (“NAI”) or the Digital Advertising Alliance (“DAA”) Self-Regulatory Program for Online Behavioral Advertising. 7.   USES OF YOUR INFORMATION. 

We may share the personal information we collect with third parties as follows or as otherwise described in this Privacy Policy:

· To process and manage personal information in accordance with this Policy, and to process Customer Data as necessary to provide the Services in accordance with any applicable agreements

· In response to a request for information if We believe disclosure is in accordance with, or required by, applicable law, regulation, legal process, or governmental request;

· If We believe Your actions are inconsistent with Our user agreements or policies, or if necessary to protect the rights, property, or safety of Company, its employees, its users, or the public;

· In connection with, or during negotiations of, any merger, sale of Company assets, financing, acquisition, divestiture, bankruptcy, dissolution, or other transaction or proceeding involving the transfer of all or part of Our business or assets, to the extent permitted under applicable law;

· Between and among Company and Our current and future parents, affiliates, subsidiaries, and other companies under common control and ownership;

· With service providers and processors that assist Us in operating the Site, fulfilling orders, processing payments, delivering products, providing analytics and advertising services, hosting data, preventing fraud, or delivering customer support;

· With advertising and marketing partners, such as Meta, Google, TikTok, and similar platforms, to support analytics, measurement, and advertising activities permitted by law, including the use of hashed or otherwise pseudonymized identifiers and event data;

· On an aggregated, anonymized, or de-identified basis that does not identify You personally; and

· With Your consent or at Your direction.

BY REGISTERING TO USE THE SERVICES, YOU CONSENT TO THE COLLECTION, USE, AND DISCLOSURE OF YOUR PERSONAL INFORMATION IN ACCORDANCE WITH THIS POLICY.    

7.1  ADDITIONAL USES OF PERSONAL INFORMATION PROVIDED. We may use the Personal Information You provide and any General Information We receive from You to provide products and services to You and other visitors and/or users, including, but not limited to, the following:

A. To administer a content promotion and provide You with relevant products or services.

B. To send You information ormaterials via e-mail about products, offers, and news that might interest You. This information may relate to products, offers, and news of the Company or its licensees or selected commercial partners. If You no longer wish to receive any e-mails from Us, or if You want to modifyYour Personal Information to alter or unsubscribe from these emails, You may unsubscribe at any time using the links provided in the emails.   

C. To analyze use of the Services and related websites, understand customer and prospective customer interests, improve user experience, refine communications and operational strategy, and support analytics, measurement, workflow optimization, and service improvement. 

D. Unless You opt to receive marketing materials, We may provide Your email information to third parties they can contact You about potential additional services and products. Even after opting out, You may continue to receive marketing emails from third parties with whom We already provided Your email information. You will be responsible for directly contacting such third parties to request the discontinuance of further marketing emails.

E. We may also share Your information, including Personal Information, which may include Your name and contact information, email address, with Our service providers that provide services on Our behalf, such as our merchant processors. 

F. To share information with service providers, advertising partners, analytics providers, and similar vendors that support Company’s marketing, advertising, customer relationship management, and business operations, subject to applicable law. 

G. To share information with vendors and service providers that assist in operating the Services, processing payments, hosting data, providing customer support, managing communications, providing security, supporting integrations, delivering analytics, and conducting business operations.

7.2 OTHER USES.  To the extent You voluntarily provide personal information in interactive areas of the Services (such as reviews, comments, or user-generated content), such information may be visible to others and may be shared accordingly.

o Provide and improve the Service.

o Address inquiries.

o Verify the information you provide is valid.

o Support compliance, risk management, and internal business purposes.

o Contact for administrative communications.

· Tailoring content, offers, and advertising, where permitted by law, on the Site, other websites or online services

· Administering and developing Our relationship with You and, if applicable, the corporation or other legal entity You represent, including affiliate or partnership relationships.

· Assessing proposals, applications, or business opportunities that You submit to Company, and preparing related internal business statistics and reports.

· Using Device Identifiers and other technical information to identify Company users for purposes such as fraud prevention, security, analytics, and personalization.

7.4  ACCESS AND RECTIFICATION.  You have the right, subject to applicable law, to access and request correction of Your personal information. You may exercise these rights by contacting Us at info@localshows.com or by using any other contact method provided in this Policy. We will respond to such requests in accordance with applicable law and may take reasonable steps to verify Your identity before fulfilling a request. In certain circumstances permitted by law, We may charge a reasonable fee or decline a request if it is excessive, repetitive, or manifestly unfounded.

These rights apply to personal information only.  

8.  DO NOT TRACK, GLOBAL PRIVACY CONTROL, AND OPT-OUT SIGNALS 

Some browsers offer a “Do Not Track” (“DNT”) setting that allows You to signal to websites that You do not wish to be tracked across different online sites and services. At this time, the Site does not respond to DNT signals because there is no industry-standard method for interpreting such signals. However, We will honor legally recognized browser-based opt-out preference signals, such as Global Privacy Control (GPC), to the extent required under applicable United States state privacy laws.

Third parties that provide analytics, advertising, or embedded content on the Site, including Google Analytics, and similar service providers, may set cookies or use tracking technologies on Your browser and may collect information about Your online activities over time and across different websites and applications. These third parties may use such information to provide measurement, analytics, or advertising services.

Third parties cannot collect Your Personal Information from the Site unless You provide it to them directly or unless such collection is allowed under applicable law and disclosed in this Policy.

Company will honor universal opt-out mechanisms recognized under applicable state laws, including Global Privacy Control (GPC), to the extent required by law.

9.  PROTECTION OF YOUR PERSONAL INFORMATION AND GENERAL INFORMATION

9.1.  RISK OF INTERCEPTION. Whenever You give out Personal Information online, there is a risk that third parties may intercept or access that information. While Company strives to protect Your Personal Information and privacy through reasonable administrative, technical, and physical safeguards, no method of transmission over the Internet or electronic storage is completely secure. By using the Site, You acknowledge and agree that We cannot guarantee absolute security of any data transmitted to or from the Site, and that You provide such information at Your own risk. Company follows the security practices made available through service providers. 

9.2 LAW ENFORCEMENT. We reserve the right to disclose any information We may have obtained about You to law enforcement authorities, governmental agencies, or other third parties when We believe such disclosure is necessary or appropriate to comply with the law, respond to lawful requests or legal processes, prevent fraud or abuse, protect the rights, property, or safety of Company or others, or otherwise fulfill legal obligations.

9.3  SHINE THE LIGHT LAWS. If You are a resident of a State that permits its residents to request information regarding the disclosure of Personal Information to third parties for their direct marketing purposes during the preceding calendar year, You may submit such a request by contacting Us in writing using the contact information provided below.   

10. NO USE OF THS SITE BY PERSONS UNDER 18 PERMITTED

10.1.   REGISTRATION DECLINED.  Only persons who are 18 years of age or older are permitted to use this website or submit Personal Information through the Site. Personal registration information submitted by a person under the age of 18 will not be accepted. Company is committed to protecting the privacy of children and has no intention of collecting Personal Information from children under the age of 18. We encourage parents and guardians of minors to regularly monitor their children’s online activities and use of e-mail and other communications.

10.2.   NOTICE CONCERNING CHILDREN. We comply with the Children's Online Privacy Protection Act (COPPA) and do not knowingly collect personal information from children under the age of 13 without verifiable parental consent.   We are a general audience site and do not direct any of Our Services, Site, or marketing to children under 13 years of age. We understand and are committed to respecting the sensitive nature of children’s privacy online. If We learn or have reason to suspect that a Site user is under age 13, We will promptly delete all Personal Information from that user’s account, consistent with applicable law. If You are a parent or guardian of a child under the age of 13 who has become a member of the Site or has otherwise provided Personal Information to Us, please contact Us using the information below so that We may take appropriate action to terminate the account and delete the information.
